In several decisions concerning clients of Hambach & Hambach, the Administrative Court of Munich has followed the EU Commission and the Bavarian Administrative Court of Appeal in deciding in favour of private eBookies. Aside from general legal considerations, it is primarily technical problems that have motivated these decisions against local restrictions on Internet sales. The tug of war on the future of the sports betting markets in Europe and in the USA continues. With the Internet Gambling Prohibition and Enforcement Act passed last year, the USA are trying to seal off the American market from without. According to the volition of the governments, this is now also meant to happen in several European countries such as Italy, France and Germany. As a centerpiece of the corresponding regulations, among other things the payment flows to foreign providers of sports bets are planned to be controlled. Pursuant to Sec. 1084 (a) (2) of the Internet Gambling Prohibition and Enforcement Act, persons participating in financial transactions to foreign providers of bets are liable to criminal prosecution.

Erich Honecker proclaimed as late as in the year 1989 - the year the Berlin wall came down - that this wall separating East Germany from West Germany would stand for another 50 or 100 years, when in fact “his people” had already set out for the West via Hungary and Romania. Today we are facing the question of the degree to which the wall currently surrounding the German state monopoly on sports betting has retained its strength. Can this “wall” in the form of a monopoly withstand the coming decades (and if so, should we approve of it), or is it irretrievably torn down even today (and would that be the effect of the law)?

Noch im Jahr des Mauerfalls im Jahre 1989 verkündete Erich Honecker, dass die Ost- von Westdeutschland trennende Mauer noch 50 oder 100 Jahre stehen würde, obwohl sich „sein Volk“ schon über Ungarn und Rumänien Richtung Westen aufgemacht hatte. Nun stellt sich die Frage, wie stark die das deutsche Sportwettenmonopol umgebene Staatsmauer noch ist. arstellte – an sich nicht von vornherein unzuläKann diese Mauer des Monopols noch die nächsten Jahrzehnte (zu Recht) standhalten oder ist sie schon heute unwiederbringlich (aus Rechtsgründen) eingerissen?

Das Tauziehen um die Zukunft der Sportwettenmärkte in Europa und den USA geht weiter. Die USA versuchen mit dem im vergangenen Jahr verabschiedeten Internet Gambling Prohibition and Enforcement Act den amerikanischen Markt nach außen abzuschotten. Dasselbe soll nach dem Willen der Regierenden nun auch in mehreren europäischen Län- dern wie Italien, Frankreich, Deutschland oder den Niederlanden geschehen; teilweise sind entsprechende Regelungen bereits in Kraft. Als Kernstück der entsprechenden Regelungen sollen unter anderem die Zahlungsströme an ausländische Sportwettenanbieter kontrolliert werden.

Derzeit ist Pokern in aller Munde und hat sich in Deutschland zu einer Art neuem Volkssport gemausert. Das Pokern (der Name „Poker“ stammt wohl vom alten deutschen Kartenspiel „Pochen“ ab) hat seinen Weg aus den USA wieder zurück nach „Good Old Germany“ gefunden. Der Re-Import dieses Kartenspiel ist damit erfolgreich vonstatten gegangen. Mittlerweile findet der Spielinteressierte nahezu wöchentlich Gelegenheit, sich zu einem der zahlreichen privat organisierten Pokerturnieren anzumelden.

Am 13.12.2006 wollen die Ministerpräsidenten der Bundesländer über die Zukunft des deutschen Glücksspiel- und Sportwettenmarktes entscheiden. Eine Neuregelung war erforderlich geworden, nachdem das Bundesverfassungsgericht in seiner Sportwettenentscheidung vom März 2006 die bisherige Ausgestaltung des Monopols für verfassungswidrig befand und dem Gesetzgeber zur verfassungskonformen Neuregelung eine Übergangsfrist bis zum 1.01.2008 einräumte.

Es gibt keine wirksame Möglichkeit für den Staat, unerwünschte Webseiten im Internet gegen den Zugriff aus Deutschland zu sperren. Die derzeit existierenden Methoden lassen sich ohne Spezialkenntnisse oder zusätzliche Hard- und Software mit zwei Mausklicks außer Kraft setzen. Zudem lässt sich technisch nicht ausschließen, dass durch eine Sperrung zahlreiche Angebote ebenfalls geblockt werden, die gar nicht Ziel der dahinter stehenden Verfügung sind. Sollen mehr als nur 1-2 Webseiten geblockt werden, ist darüber hinaus ein System erforderlich, welches regelmäßige automatische Aktualisierungen der Sperrlisten ermöglicht.

The study on the gambling sector in the European Union, conducted by the Swiss Institute of Comparative Law on behalf of the European Commission, confirms that there is considerable variance between the national laws and regulations in the Member States. The Study also found that these laws and regulations often lead to restrictions to the freedom to provide services and the freedom of establishment guarantees that are incompatible with existing EU Law. This also applies to the German part of the study, which is also based on the observations of Hambach & Hambach (appendix 5, p. 1761).

On 23rd October 2006 the Higher Regional Court Düsseldorf approved all of the major points of a decision of the German Federal Cartel Office of 23rd August 2006. As a consequence, the German state-run lottery companies will now be obliged to accept lottery tickets from private intermediaries. The court pointed out that the new state treaty on lotteries, which the German Länder is drafting at the moment, will also have to comply with European cartel law. The German monopolists announced that they intend to appeal the decision to the Federal Court of Justice.

In the aftermath of the fundamental decision of the German Federal Constitutional Court on private sports betting in March 2006, the Prime Ministers of the German Lander decided by majority to preliminarily retain the monopoly on games of chance including sports bets. The details of this monopoly will be regulated in a new lottery state treaty which shall come into force at the beginning of 2008, i.e. within the time-limit set by the Federal Constitutional Court. In August 2006, a first draft was presented, which prohibits e.g. all gambling including sports betting, casino operations (including poker) and lotteries via TV or Internet channels.
