According to a report in today's economic magazine "Handelsblatt" the EU Commission is planning to initiate an action for infringement of the EC Treaty against Germany. In the Commission's opinion the state gambling monopoly in place in Germany in particular infringes the freedom to provide services as provided for by the EC Treaty. This action for infringement of the treaty is governed by Art. 226 of the EC Treaty and is composed of several steps. First, after an informal finding of the facts, the Commission notifies the concerned state formally, thus formally initiating the action.

Nach einer heutigen Meldung des "Handelsblatts" will die EU-Kommission ein Vertragsverletzungsverfahren gegen Deutschland einleiten. Nach Ansicht der Kommission verstößt das in Deutschland geltende staatliche Monopol für Sportwetten insbesondere gegen die durch den EG-Vertrag garantierte Dienstleistungsfreiheit. Dieses Vertragsverletzungsverfahren ist in Art. 226 des EG-Vertrages geregelt und läuft in mehreren Schritten ab. Erster Schritt ist nach einer informellen Sachverhaltsaufklärung die förmliche Benachrichtigung des betreffenden Mitgliedstaates durch die Kommission, durch die das Verfahren formell eingeleitet wird.

One more district court has explicitly refused to speak out a punishment for cross-boarder provision of sporting bets in accordance with Art. 284 German Criminal Code. The District Court of Cologne (Landgericht Köln) in its decision of April 21st 2005, case no. 105 Qs 80/05) points out the importance of community law and the necessity for German courts to take into consideration the "Gambelli Criteria".

As we already mentioned in issue 18 of our newsletter "German Gaming Law updated" many crucial legal question will be resolved this year. In the WTO case Antigua v. USA the WTO's Appelate Body has meanwhile reached its decision (without really bringing clarification to the crucial questions, so that both sides claim to have won). Next to the upcoming "Gambelli II" decision (dealing with Italian facts concerning the case "Placanica") there will probably soon be a "Gambelli III" decision concerning several German cases.

As we already mentioned in our last newsletter, in the context of several preliminary procedures, the Federal Constitutional Court (Bundesverfassungsgericht) asked the local regulatory authorities not to take any measures against agents of sporting bets anymore. Despite this clear request issued by the highest German court, even during the last weeks many state authorities (especially those in Hessia, Bavaria and North-Rhine Westphalia) have kept trying to enforce so called orders of interdiction (Untersagungsverfügungen) by force, threatening to seal betting shops and to take away computers and printers.

Ein weiteres Landgericht hat die Strafbarkeit nach § 284 StGB bezüglich der binnengrenzüberschreitenden Vermittlung von Sportwetten ausdrücklich abgelehnt. Das Landgericht Köln weist in dieser Entscheidung auf die Bedeutung des Gemeinschaftsrechts und die erforderliche Beachtung der „Gambelli-Kriterien“ durch die deutschen Gerichte und Behörden hin (Beschluss vom 21. April 2005, Az. 105 Qs 80/05)

Das Bundesverfassungsgericht hatte – wie wir bereits in unseren letzten Ausgaben unseres Newsletters „Sportwettenrecht aktuell“ berichteten – Ende des letzen und Anfang dieses Jahres in mehreren Verfahren des einstweiligen Rechtsschutzes die Ordnungsbehörden gebeten, bis zu einer Entscheidung in der Hauptsache nicht gegen Vermittler von Sportwetten vorzugehen. Trotz dieser klaren Bitten des höchsten deutschen Gerichts wollten viele Ordnungsbehörden (vor allem in Bayern, Hessen und Nordrhein-Westfalen) weiterhin Untersagungsverfügungen gegen Wettannahmestellen...

Neben der anstehenden „Gambelli II“-Entscheidung (in dem einen italienischen Sachverhalt betreffenden Fall Placanica) wird es voraussichtlich bald auch eine „Gambelli III“-Entscheidung zu einem deutschen Fall geben. Endlich hat ein deutsches Gericht angekündigt, die aufgeworfenen Rechtsfragen dem Europäischen Gerichtshof zur Vorabentscheidung vorzulegen. Interessant ist dabei der Umstand, dass nicht nur Sportwetten, sondern auch Casino Games streitgegenständlich sind.

The Federal Administrative Court decided on the 9th of March 2005 that a trade amusement licence may be necessary to operate an “internet café” (case no. 6 C 11.04). Under Art. 33i of the Trade, Commerce and Industry Regulation Act (Gewerbeordnung, GewO), a licence of this type is required by anyone who wishes to operate an amusement arcade or a similar business which predominately supplies gaming equipment or games with profit potential or commercial amusement games without profit potential

Part 1 dealt with International Private Law issues. Under German Law, legally binding consumer regulations cannot be waived. In part 2, I will outline the (relatively complex) principles behind an AGB examination under German law as well as the individual examination steps and criteria. From a legal point of view, betting regulations, particularly gambling terms and conditions, are considered – irrespective of how they are labelled – to be “AGB”s (Allgemeine Geschäftsbestimmungen, standard terms and conditions of business), i.e., contract conditions put forward by one side for use in a multiplicity (according to jurisprudence, at least 3) of instances.

The “million dollar question” for many who are directly affected by this decision is: What will the Federal Constitutional Court decide? Ultimately, one can only speculate on this as the Federal Constitutional Court has clearly political considerations in mind based on its personnel composition as well as its conceptual formulation (in particular the billion euro state revenue). Because of this, a full liberalisation cannot seriously be expected.

Teil 1 beschäftigte sich mit Fragen des sog. Internationales Privatrechts. Nach deutschem Recht können gegenüber Verbrauchern zwingende Rechtsvorschriften nicht abbedungen werden. In Teil 2 stelle ich die (relativ komplexen) Grundsätze einer AGB-Prüfung nach deutschem Recht sowie die einzelnen Prüfungsschritte und -kriterien dar. Wettbestimmungen bzw. Spielbedingungen stellen – ganz egal wie sie bezeichnet sind - rechtlich gesehen sog. Allgemeine Geschäftsbestimmungen (AGB) dar, d. h. einseitig gestellte Vertragsbedingungen für eine Vielzahl von Verwendungsfällen (laut Rechtsprechung mindestens drei).
