The Court of Appeal of Munich (Oberlandesgericht München), in its decision of 26 September 2006 (case no. 5 St RR 115/05), on an appeal on a point of law, affirmed exemption from punishment for transferring sporting bets on the basis of the current legal situation and practise. The Court of Appeal of Munich explicitly abandons the former case law of the Bavarian Supreme Court of Appeal (Bayerisches Oberstes Landesgericht). In its reasoning, the court invokes the Gambelli decision of the European Court of Justice and establishes.

Gambling services represent a multi billion market. Given the legal barriers still in force, this market is still very much fragmented on national as well as regional levels and far from being able to be called an internal market. The Internal Market and Services Commissioner Charlie McGreevy pleads for the enforcement of the freedom to provide services in this market as well. The European Commission had asked the Swiss Institute of Comparative Law to carry out a study into the sector ("Study of Gambling Services in the Internal Market of the European Union"), which was recently published in its final version.

Das Oberlandesgericht (OLG) München hat - wie berichtet (Sportwettenrecht aktuell Nr. 45) - mit Revisionsurteil vom 26. September 2006 die Straflosigkeit der Vermittlung von Sportwetten nach der derzeitigen Sach- und Rechtslage bestätigt (Az. 5 St RR 115/05). Die frühere Rechtsprechung des Bayerischen Obersten Landesgerichts wurde vom OLG damit ausdrücklich als überholt aufgegeben. Das Gericht verweist in den Urteilsgründen auf das Gambelli-Urteil des Europäischen Gerichtshofs und hält fest:

Glücksspieldienstleistungen stellen einen Milliardenmarkt dar. Dieser ist allerdings angesichts rechtlicher Barrieren immer noch sehr stark national und regional fragmentiert und von einem Binnenmarkt derzeit weit entfernt. Für eine Durchsetzung der Dienstleistungsfreiheit auch in diesem Wirtschaftsbereich setzt sich der Binnenmarktkommissar Charlie McCreevy ein. Die Europäische Kommission hatte bei dem Schweizerischen Institut für Rechtsvergleichung eine umfangreiche Studie hinsichtlich der einen tatsächlichen Binnenmarkt verhindernden Barrieren in Auftrag gegeben

There are more than 2.000 cases regarding the cross-border provision of sports betting pending before German courts at the moment. The cases are about the freedom to provide services and the freedom of establishment granted by the EC Treaty and their collision with the state monopoly for sports betting currently in effect in Germany. A German court has now, for the first time ever, asked the European Court of Justice (ECJ) for its opinion on this in accordance with Article 234 EC Treaty. In its Gambelli decision of 2003, the ECJ had already established the relevant criteria regarding this conflict.

In Deutschland sind derzeit weit über 2.000 Gerichtsverfahren bezüglich des binnengrenzüberschreitenden Angebots von Sportwetten anhängig. Hierbei geht es vor allem um die durch den EG-Vertrag garantierte Dienstleistungs- und Niederlassungsfreiheit und deren Kollision mit dem derzeit in Deutschland bestehenden Sportwettenmonopol. Erstmals hat nunmehr ein deutsches Gericht eine Vorlagefrage hierzu dem Europäischen Gerichtshof (EuGH) entsprechend Art. 234 EG-Vertrag vorgelegt.

Last Friday, 29 September 2006, U.S. Congress passed the Unlawful Internet Gambling Enforcement Act whose draft had been introduced in 2005. The quick adoption was made possible by a procedural artifice. The bill was added as title VIII to the SAFE Port Act, a security act aimed at enhancing U.S. port security, by the Committee of Conference, hence passing the legislative procedure without changes or further amendments. The U.S. President is expected to sign the bill into law within the next days. The new act is meant to hamper payments of U.S. citizens with regard to Internet gambling which is unlawful according to the U.S. legal conception.

The Court of Appeal of Munich (Oberlandesgericht München), in its decision of 26 September 2006 (case-no. 5 St RR 115/05), affirmed that transmitting sporting bets does not incur a penalty. Criminal prosecution for illegal gambling in accordance with Art. 284 German Criminal Code was excluded for reasons of Community law as well as of constitutional law. This final judgement of appeal, which affirmed a sentence of acquittal by the County Court of Landshut (Amtsgericht Landshut), has an important effect on the legal situation in Bavaria.

Der US-amerikanische Kongress verabschiedete am letzten Freitag, den 29. September 2006, den bereits 2005 als Gesetzesinitiative eingebrachten Unlawful Internet Gambling Enforcement Act. Die schnelle Verabschiedung wurde durch einen Verfahrenstrick möglich. Der Gesetzesentwurf wurde durch einen Kongressausschuss, dem Committee of Conference, einem Sicherheitsgesetz, dem den Schutz US-amerikanischer Häfen betreffenden SAFE Port Act, als Abschnitt VIII angefügt und passierte so ohne weitere Änderungen und Verzögerungen das Gesetzgebungsverfahren.

Das Oberlandesgericht (OLG) München hat mit Urteil vom 26. September 2006 die Straflosigkeit der Vermittlung von Sportwetten bestätigt (Az. 5 St RR 115/05). Eine Strafbarkeit wegen unerlaubten Glücksspiels (§ 284 StGB) sei sowohl aus europarechtlichen wie auch aus verfassungsrechtlichen Gründen ausgeschlossen. Dieses Revisionsurteil, mit dem ein Freispruch durch das Amtsgericht Landshut letztinstanzlich bestätigt wurde, hat erhebliche Auswirkungen auf die Rechtslage in Bayern.

Several follow-up decisions to the ECJ’s Gambelli decision, a fundamental decision on the freedom to provide services with regard to sports betting, are at hand. As reported, the ECJ will probably pronounce its judgement in the joined cases of Placanica et. al. (Cases C-338/04, C-359/04 and C-360/04) in the course of this year. If the Court follows the Advocate General’s opinion on these three Italian cases, delivered on 16 May 2006, this would mean the factual end of the state monopoly on sports betting and games of chance in Germany.

Zu dem Gambelli-Urteil, eine Grundsatzentscheidung des Europäischen Gerichtshofs zur Dienstleistungsfreiheit bei Sportwetten, stehen nunmehr zahlreiche Folgeentscheidungen an. Wie berichtet, wird der Europäische Gerichtshof voraussichtlich noch in diesem Jahr seine Entscheidung in den verbundenen Rechtssachen Placanica u. a. (Rs. C-338/04, C-359/04 und C-360/04) verkünden.
