As reported in the last edition of Betting-Law-News, a number of complaints have been brought against Germany as well as other member states for infringements of European Law. Under Art. 226 of the EC Treaty the EU Commission is obliged to deal with complaints raised against member states for infringements of the Treaty. The issue of "sports betting / gambling complaints" was raised at a Commission "Infringements Meeting" in early Summer where around 1500 complaints were raised. Due to the number of complaints in other areas, it was decided to discuss this issue at the next quarterly Infringements Meeting.
Besides the gambling provisions, providers of online games must also observe extensive Internet law information requirements. Anyone who is working in the e-commerce area must observe a huge range or regulations on Internet law. For example, in Internet trade, distance sales law can be invoked, which is regulated in the German Civil Code (BGB) and in the BGB-Information Obligation Regulation (BGB-InfoV). The Teleservices Law (Teledienstegesetz) and the data protection provisions such as the Teleservices Data Protection Law (Teledienstedatenschutzgesetz) can also play a role.
Munich, 14.9.2005. Two and a half years ago, Advocate General of the ECJ Siegbert Alber delivered his Opinion in the now legendary “Gambelli” case. On the 15.10.2003 – shortly before the ECJ reached the Gambelli Decision – the Administrative Court of Stuttgart had already referred (case no.: 10 K 1472/05) to Alber. In this decision, which favoured a private sports betting provider, the Court referred to the fact that the Advocate General (in his Opinion of the 13.03.2003) argued that the limitation of the freedom of services guarantee could no longer be justified by overriding reasons of general interest. This is particularly the case against a background of increasingly aggressive advertising by licensed sports betting organisers and state financial interests.

The Gauselmann Group currently runs 40 entertainment centres overseas European countries, 14 alone in the Czech Republic. From these 14 MERKUR CASINOs four are located in the “Golden City” of Prague on the Moldau. Paul Gauselmann would not be the highly successful business man and owner of the worldwide operating concern if he did not have the flair to combine “business with pleasure”.
