The ongoing persecution of Internet gambling sites by the United States Department of Justice may be nearing an end after several years of acrimony. Word spreading throughout the online casino industry is that a large fine that will still not bankrupt the companies involved may be the settlement. Online casinos such as SportingBet and PartyGaming and their executives have been pursued by US law enforcement since the passage of the Unlawful Internet Gambling Enforcement Act in 2006.

One of America’s most prominent lawyers in the field of online gaming is optimistic that the Unlawful Internet Gambling Enforcement Act (UIGEA) could soon be a thing of the past if Barack Obama wins the Presidential election next month. Anthony Cabot, a Partner in Phoenix-based law firm Lewis and Roca, has been practicing for more than 27 years and was instrumental in the passage of legislation in the 1980s allowing for casinos to go after unpaid gambling debts.

The Norwegian Government has continued to press forward with legislation to ban payments handling online poker and internet gambling transactions, UIGEA-style. The government has formally submitted its proposed ban for a parliamentary vote, reports Gambling Compliance. The proposed ban, which widens the Norwegian definition of the offence of ’mediating’ bets, has already attracted widespread concern, pro and con.

While attending a recent celebrity poker tournament near the Democratic Convention in Denver, Representative Barney Frank did not act defeated regarding the failure of his bill to prevent the enforcement of the UIGEA to escape committee. The Remote Gambling Association (RGA) endorsed the UIGEA Clarification Act (HR 6663) and expressed strong support for its sponsors for taking positive action to clarify the law. The main purpose of the UIGEA Clarification Act is to clarify that online gambling operators who did not offer sports betting and withdrew completely from the United States market upon passage of UIGEA would avoid federal prosecution in the United States.

Once again, legislation has been introduced before the US Congress seeking to manage the usage of the UIGEA while mitigating the harmful effects. Republican Pete Sessions has composed a measure designed to remove the vagaries of the UIGEA, as well as specify exactly what illegal conduct is targeted. Sessions’ bill acknowledges the confusion and disarray caused by the UIGEA. It also states the conflicting and outdated nature of American laws concerning gambling.
