Nachdem in Kentucky der Domain-Fall zu Gunsten der Beklagten ausgegangen war und auch in Pennsylvania das Pokerspiel von einem Gericht als „Geschicklichkeitsspiel" beurteilt wurde, häufen sich nun Gerichtsurteile die Poker von illegalem Glücksspiel ausnehmen. Liegt es am neuen Präsidenten? An derzeit herrschender Umbruchstimmung in den USA? Seit einigen Wochen scheint es fast so, also ob die US-Gerichte ihre Meinung über das Pokerspiel grundlegend geändert hätten.

Schon seit 18. September 2008 sind 141 namhafte Internet-Pokersites, darunter Absolute Poker, FullTilt Poker, PokerStars oder Bodoglife, für Bewohner des Bundesstaats Kentucky gesperrt. Jetzt endlich gab es das Urteil, ob die Sperrung rechtens sei – das Gericht entschied FÜR die Pokersites. Derzeit scheinen Gerichtsurteile im Bezug auf Glücksspiel bzw. Poker in den USA wieder Hochkonjunktur zu haben – gerade erst der Richterspruch in Pennsylvania und jetzt endlich Kentucky.

Washington, DC (January 21, 2009) – John Pappas, executive director of the Poker Players Alliance (PPA), the leading poker grassroots advocacy group with more than one million members nationwide, today issued the following statement regarding the appeal filed by the Commonwealth of Kentucky in light of yesterday’s ruling by the state court of appeals overturning a lower court decision allowing the Commonwealth to seize Internet gambling domain names.

Louisville, Kentucky (January 20, 2009) – The Kentucky Court of Appeals today issued a ruling prohibiting the Franklin Circuit Court from enforcing its seizure order against the 141 domain names in the domain seizure case. The Court found that Internet domain names do not constitute a gambling device under Kentucky law and that the Franklin County Circuit Court clearly erred in concluding that the domain names can be construed to be gambling devices subject to forfeiture.

Louisville, Kentucky - Kentucky authorities want to seize 140 Internet domain names, saying the web sites bring illegal gambling within the borders of the commonwealth. Attorneys for a trade association for the gambling web sites countered that Kentucky lacks the authority to make that move because the domain names aren't property and, besides, they are based offshore and beyond Kentucky's jurisdiction. A three-judge appeals court panel in Kentucky is now weighing whether a state can seized a web site domain name to curtail gambling within its borders...
