CJEU: The End of Copyright Claims for sport fixture lists

The Court of Justice of the European Union (CJEU) today delivered its ruling (case C-604/10) in a case referred from the Court of Appeal (England & Wales). The fixture lists, for each season of the leagues, set the dates and venues for every match to be played. Football Dataco et al, claimed that there was in the fixture lists a sui generis right and a copyright under the Database Directive and a copyright under UK law.

Poker Players Alliance Commends S.C. Court’s Finding that Poker is a Game of Skill, Not Chance

Washington, DC (February 19, 2009) –The Poker Players Alliance (PPA), the leading poker grassroots advocacy group with more than one million members nationwide (nearly 10,000 in South Carolina), today expressed cautious optimism with a ruling in the Mount Pleasant, S.C. poker case and applauded the Court’s findings that poker is a game of skill, not chance. Though disappointed with the Court’s initial conclusion that the defendants had committed a crime, PPA expects to prevail on further review.

Washington, DC (January 26, 2009) -The Poker Players Alliance (PPA), the leading poker grassroots advocacy group with more than one million members nationwide and more than 13,000 in Colorado, today commended the ruling in Colorado v. Kevin Raley, in which a jury found the organizer of a poker league not guilty of illegal gambling. The lawyers for the defense presented expert testimony by Professor Robert Hannum, Professor of Statistics at the University of Denver, that poker is a game of skill.

Poker Players Alliance reaction to today’s Kentucky Court of Appeals ruling

Louisville, Kentucky (January 20, 2009) – The Kentucky Court of Appeals today issued a ruling prohibiting the Franklin Circuit Court from enforcing its seizure order against the 141 domain names in the domain seizure case. The Court found that Internet domain names do not constitute a gambling device under Kentucky law and that the Franklin County Circuit Court clearly erred in concluding that the domain names can be construed to be gambling devices subject to forfeiture.

Kansas high court upholds state’s gambling law

Chicago (Reuters) - The Kansas Supreme Court ruled on Friday that a gambling law allowing state-owned casinos and slot parlors is constitutional, upholding a previous ruling on the law. The case was filed in 2007 by former Kansas Attorney General Paul Morrison on behalf of the state in an attempt to test the law's constitutionality and clear any potential legal hurdles. The ruling means plans for casinos and slots owned by the state can go forward.

UK to rule on bingo hall slot machines

London (Reuters) - Britain will make an announcement on Wednesday about slot machines in bingo clubs, a government source said on Monday, in a move expected to give the sector a lift by relaxing limits on the number of slot machines. An industry source said the government would announce plans to raise from four the maximum number of 500-pound (USD 980) jackpot slot machines allowed in bingo clubs and was expected to choose from one of three options put to it by operators.

Ladbrokes Loses Dutch Court Ruling Over Online Bets

Ladbrokes Plc, the world's largest publicly traded gaming company, can't offer gambling in the Netherlands without a permit, the Dutch Supreme Court ruled. The Harrow, England-based company violated Dutch law by allowing national residents to place bets on its Web site, the court said in a ruling today. The decision is contingent upon whether European Union tribunals rule the bloc's antitrust regulations supersede national gaming laws.

Bwin Loses Interim Ruling Over German Betting Order

Bwin Interactive Entertainment AG said it lost a bid to have Germany's highest civil court halt the enforcement of a ruling barring it from offering sport bets and casino games in Germany over its www.bwin.com Web site. Bwin had asked the Federal Court of Justice in Karlsruhe, Germany, to halt enforcement of a September court ruling against the online broker while Bwin appeals, the Vienna-based company said in a statement. The shares fell 7.1 percent.
