The regulatory body for casinos, bingo, gaming machines and lotteries in Great Britain, the Gambling Commission, has announced that the numbers of people going online to place a bet in the UK is on the rise. The Gambling Commission made the announcement upon releasing the findings of its latest survey carried out in June. This examination found that 8.6 percent of UK adults had taken part in at least one form of online gambling during the previous month, up from 7.4 percent last year.

The Conference of the Caribbean Community, at its recent meeting in Barbados, expressed its appreciation and pledged its support for the efforts of Congressman Barney Frank and his legislation to regulate Internet gambling in the United States. Tony Blair's plans to allow betting shops and internet gambling websites to advertise on television and radio are set to be ditched. Blair and Tessa Jowell, the former culture secretary, had planned legislation that would have removed the ban. The change of policy, indicated by James Purnell, the new culture secretary, is a further sign that Gordon Brown has abandoned the widespread liberalisation of gambling planned by his predecessor.

An American attorney is taking legal action against the western state of Washington claiming that its online wagering ban infringes the US Constitution’s protections of interstate trade. Lawyer and poker aficionado Lee Rousso has filed suit in King County Superior Court in an effort to overturn the State’s ban on Internet gambling, a topic that also has the US mired in international trade disputes. “I think my chances are darn good,” said Rousso.

Spanish The Tax Agency is investigating the growing Internet betting business. A sector which in 2006 generated 413 million euros in Spain, a 65% more than the previous year, which put the country on the top of the European ranking on online gaming. The Finance Ministry controls the activity of these companies, considered illegal by the Law of General Budget of the State for 2007.

Geneva: The tiny Caribbean nation of Antigua and Barbuda slammed the United States over its illegal restrictions on Internet gambling sites based overseas and asked other countries to join in seeking compensation from Washington for its failure to comply with global trade rules. So kann beim Internet-Handel etwa das Fernabsatzrecht greifen, welches im Bürgerlichen Gesetzbuch (BGB) und in der BGB-Informationspflichtenverordnung (BGB-InfoV) geregelt ist. Aber auch das Teledienstegesetz oder auch datenschutzrechtliche Vorschriften wie das Teledienstedatenschutzgesetz spielen eine Rolle.

Das Landgericht Köln hat in seiner Entscheidung vom 28.04.2005 (Az. 31 O 600/04) sämtlichen Beklagten - einschließlich der Domaininhaber - das Angebot und die Bewerbung von Sportwetten im Internet wegen eines Verstoßes gegen die §§ 3, 4 Nr. 11 UWG in Verbindung mir § 284 Abs. 1 StGB untersagt. In der Sache selbst bleibt das Gericht auch nach erneuter Überprüfung der Rechtslage nach der Gambelli-Entscheidung des EuGH bei der in ständiger Rechtsprechung geäußerten Auffassung...

Bislang war es ständige Rechtsprechung (OLG Hamburg, MMR 2000, 92 - Golden Jackpot 1; MMR 2002, 471 mit Anm. Bahr 2), dass Gewinnspiele (auch Internet-Gewinnspiele) nur dann in Deutschland rechtlich zulässig sind, wenn sie eine deutsche, behördliche Erlaubnis hatten. Dies hatte u.a. zur Folgen, dass ein Unternehmen, dass auf eine ausländische Webseite linkte, die ihre Wett-Angebote auch in Deutschland anbot, wettbewerbswidrig handelte, da darin ein "Werben" iSd. § 284 Abs.4 StGB lag.
