Das US Justizministerium antwortete in einem kurzen Brief bezüglich der Anfechtung des Unlawful Internet Gambling Enforcement Acts durch die Interactive Media Entertainment & Gaming Association. Obwohl der erste Versuch der IMEGA das Gesetz zu kippen gescheitert war, hat die iMEGA alle rechtlichen Mittel ausgeschöpft, um weiter für ihr Ziel zu kämpfen und aus diesem Grund im späten September eine weitere Berufung auf bundesstaatlicher Ebene eingereicht.
Die in den USA hoch angesehene Interactive Media Entertainment & Gaming Association (iMEGA) legte vor kurzem Berufung gegen die Entscheidung des Gerichts von Kentucky ein, laut jener Entscheidung sollten 141 Domains von Onlinegamingseiten beschlagnahmt werden. Die iMEGA, in der einige der betroffenen Seiten vertreten sind, stellte in einem Antrag auf Aufhebung des Verfahrens mindestens fünf Justizfehler des Richters Thomas Wingate heraus.
The US Department of Justice has announced a new attorney for its case in defense of the Unlawful Internet Gambling Enforcement Act (UIGEA) of 2006 brought by the Interactive Media Entertainment and Gaming Association (iMEGA). Attorney Nicholas John Bagley graduated in 2005 from New York University (NYU) School of Law near the top of his class after receiving his Bachelors Degree from Yale University.
U.S. District Court Judge Mary Cooper sent two very clear messages to the online gaming industry last week: 1. The courts are not going to overturn the Unlawful Internet Gambling Enforcement Act (UIGEA) because the law is either ineffective or unwise. 2. The iMEGA case has very little chance of overturning the UIGEA. The only glimmer of hope Cooper gave iMEGA was she granted it "standing" on certain issues.
IMEGA is suing US Attorney General Alberto Gonzalez, the US Department of Justice, the Federal Trade Commission and the Federal Reserve Board of Governors seeking a judgement for a temporary restraining order on the enforcement of the Unlawful Internet Gambling Enforcement Act (UIGEA) 2006. This Act prevents American-based credit card companies and banks from processing payments to online gambling businesses with violators subject to civil and criminal penalties including imprisonment.
